A third or subsequent DUI conviction is a third-degree felony, which is punishable by 2 to 10 years in prison, a fine of up to $10,000, and a license suspension of up to 2 years.

What Happens if You Refuse to Take a Breath Test in Texas?

Under Texas' implied consent laws, all drivers are required to submit to a breath or blood test if they are arrested on suspicion of drunk driving. If you refuse to take a breath or blood test, you may face an automatic driver's license suspension. The length of the suspension will depend on whether you have refused a test in the past. You only have 15 days to request an administrative hearing to challenge the suspension, so it is important to hire an attorney as soon as possible.
