There are two requirements which must be met:

  • First, the petitioner may not have been convicted or placed on deferred for a list of restricted offenses. Some of the restricted offenses include but are not limited to: family violence offenses, those offenses requiring sex offender registration, injury to a child, and protective order cases.
  • Second, the petitioner must not have been convicted or placed on deferred for any offense other than a fine only traffic offense from the time of sentencing until the waiting period has passed.
